By requesting a project estimate, booking equipment services, providing your contact data, or interacting with our mobile updates, you confirm your acceptance of these Terms without reservation.
1. Scope of Work
These legal provisions apply to every project handled by JM Land Works, encompassing:
• Forestry Mulching and Underbrush Removal
• Skid Steer Services and Site Reclamation
• Tree Felling, Pruning, and Debris Disposal
• Professional Snow Management and Plowing
• Machinery-Based Solutions (including specialized equipment)
• Professional Consultations and Project Appraisals
2. Financial Provisions and Quotes
• Every project estimate reflects data collected during site visits; final billing may vary based on terrain complexity, vegetation density, or accessibility hurdles.
• Standard quotes remain active for 30 calendar days from issuance.
• Major projects exceeding $10,000 necessitate a 10% down payment to confirm equipment availability.
• Down payments are fully returnable if notice is given 14 days before the start date.
• Cancellations within the 14-day window result in forfeiture of the deposit.
• Remaining balances are due immediately upon project wrap-up unless otherwise formalized.
• Delinquent accounts may face legal collection, property liens, or court proceedings.
3. Client Obligations
By hiring JM Land Works, you certify the following:
• You hold legal title to the property or possess verifiable proxy rights.
• You authorize the operation of heavy industrial machinery on the site.
• You will identify and communicate all underground utilities, septic systems, and pipes.
• You will mark visible boundaries and remove any site obstructions.
Hazard and Utility Disclosure Policy:
JM Land Works maintains no liability for damage to unmarked underground assets or undisclosed site hazards. All costs for repairs to such items remain with the client.
4. Heavy Machinery and Property Liability
• JM Land Works utilizes substantial industrial equipment that naturally impacts the ground.
• We are not responsible for minor cosmetic changes to turf, gravel, or soil during standard operation.
• The client acknowledges that clearing and grading will result in natural landscape alterations and accepts all related outcomes and terrain modifications.
5. Winter Service and Turf Limitations
• Snow cover hides underlying property features and terrain.
• JM Land Works is not liable for structural or landscape damage caused by snow removal tools unless a specific written waiver is signed prior to the incident.
6. Digital Communication Protocols
By engaging with JM Land Works, you opt into our communication channel for project confirmation.
You consent to receive periodic automated marketing and operational texts from JM Land Works at the mobile number provided. These transmissions may use automated dialers for efficiency.
Topics covered include estimate updates, service scheduling, work progress alerts, maintenance reminders, client support, and exclusive seasonal promotions for our land services.
7. Operational Limits and Warranties
• All land services are performed on an "as-is" basis without implied warranties.
• JM Land Works cannot promise specific growth prevention due to unpredictable weather, soil health, or wildlife interference.
8. Environmental and Timing Factors
• We reserve the right to delay activity due to hazardous weather or mechanical needs.
• Client deposits remain secure if JM Land Works determines a schedule change is necessary.
9. Project Changes and Cancellations
• All cancellation notices must be sent to jmlandworks360@gmail.com.
• Refunds for $10,000+ projects are honored only with 14+ days of advance notice.
• Smaller residential tasks allow for a single no-cost rescheduling if requested 72 hours prior.
10. Liability Constraints
• Maximum liability for JM Land Works is capped at the total amount invoiced for the specific job.
• We are not responsible for consequential or punitive damages.
• The Customer will protect JM Land Works against claims resulting from undisclosed site dangers.
11. Jurisdictional Authority
• These Terms are governed by the legal statutes of the Commonwealth of Virginia.
• Legal disputes shall be settled exclusively within the court system of Spotsylvania County.
12. Policy Modifications
• JM Land Works reserves the right to revise these terms at our discretion.
• Continued request for services indicates your binding agreement to the most recent version.
